Calif. Man Pleads Guilty

June 8, 2012

ST. MARYS — A California man admitted to posting nude images of his then-underage friend on the Internet as well as using a popular social media site to disseminate the material.

Andrew J. Gehfeld, 21, Mission Viejo, Calif., pleaded guilty Friday morning to two counts of pandering sexually oriented matter involving a minor, both second-degree felonies, and one count of pandering obscenity, a fifth-degree felony, as part of a plea agreement struck between his attorney, Eric Wilson, and Auglaize County Prosecuting Attorney Ed Pierce. In exchange for the guilty plea, Pierce agreed to dismiss two additional felonies — two counts of illegal use of a minor in nudity-oriented material or performance, second-degree felonies.

An Auglaize County grand jury indicted Gehfeld in April on the felonies. According to a police report, the victim in the case contacted the St. Marys Police Department on July 23, 2010, and reported nude images of her when she was a minor were placed on the Internet by Gehfeld — who was a former acquaintance.

“The filming and photographing was all when she was under the age of 18,” Pierce said. “Count four deals with Facebook messaging, at which Mr. Gehfeld did send Facebook messages offering to deliver to an individual in St. Marys, Auglaize County, Ohio, material depicting the victim.”

During his sentencing hearing, Gehfeld will be labeled a Tier II sexual offender. That status requires him to register his address every six months for 25 years following his release from prison. Under terms of the plea agreement, Gehfeld faces a maximum of 17 years in prison. At the sentencing hearing, Pierce indicated he would recommend any sentence imposed on the two second-degree felonies be served concurrent to each other.

Gehfeld initially faced a maximum of 33 years in prison under charges contained within the original indictment. He is currently being held in the Auglaize County Jail on a $300,000 bond with a 10 percent cash provision.
